Acceptance of These Terms
These Terms of Use and End User License Agreement (the "Terms") form a binding agreement between you ("you", "User") and Falak Group ("Falak", "we", "us", "our") governing your access to and use of the Falak AI: More Than Flashcards mobile application and related services (collectively, the "App"). By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download, install, or use the App.
In addition to these Terms, Apple's Licensed Application End User License Agreement (the "Standard EULA") applies to your use of the App on Apple devices. The Standard EULA is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms and the Standard EULA conflict, the Standard EULA governs only to the extent of that conflict for the Apple-specific matters it covers.
Eligibility and Age
The App is intended for students and learners. You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. Account Responsibilities
To access certain features you may need to create an account. You agree to:
- provide accurate, current, and complete information and keep it updated;
- maintain the confidentiality of your login credentials and any device-level authentication;
- be solely responsible for all activity that occurs under your account;
- notify us promptly at [email protected] of any unauthorized use or security breach.
You may not share, sell, or transfer your account, and you may not impersonate any person or misrepresent your affiliation with any person or entity.
The Service
Falak is an AI-assisted study application — "more than flashcards." Features may include:
- Sky — an AI tutor you can ask anything, providing step-by-step explanations;
- Learning Paths — personalized study journeys;
- Knowledge Bank — upload your own PDFs and notes for the AI to read and use;
- Auto-generated study materials — notes, flashcards, quizzes, and exams;
- support for 30+ languages.
Features may be added, modified, or removed at any time. Some features require an active subscription (see the "Subscription Terms" section).
Subscription Terms (Falak Pro)
Certain features require a paid auto-renewable subscription that unlocks the Falak Pro entitlement.
- Plans and pricing. Falak Pro is offered as an auto-renewable subscription:
- Weekly — US$14.99 per week
- Quarterly — US$24.99 per 3 months
Prices are shown in the App and may vary by region, currency, and applicable taxes. Indicated prices are subject to change; any change will apply only to future billing periods after notice.
- Billing. Payment is charged to your Apple ID account upon confirmation of purchase.
- Auto-renewal. The subscription automatically renews for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
- Managing and cancelling. You can manage or cancel your subscription, and turn off auto-renewal, in your device's App Store account settings at any time after purchase. Cancellation takes effect at the end of the current billing period; you retain access until then.
- Free trials / promotions. If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription. Terms of any promotion are disclosed at the point of offer.
- Refunds. All purchases are processed by Apple and are final. We do not provide refunds except where required by law. Refund requests are handled solely under Apple's App Store refund policy; please contact Apple Support.
Acceptable Use
You agree not to, and not to permit others to:
- use the App for any unlawful, fraudulent, or harmful purpose, or in violation of any applicable law or academic-integrity rule;
- upload, generate, or share content that is illegal, infringing, defamatory, hateful, harassing, sexually explicit involving minors, or otherwise objectionable;
- upload content you do not have the right to use, or that infringes any third party's intellectual property, privacy, or other rights;
- attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App, except to the extent permitted by law;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the App, its servers, or related systems;
- use bots, scrapers, or automated means to access the App, or resell, sublicense, or commercially exploit the App or its outputs without our written permission;
- use the App to develop a competing product or to train a competing model.
We may suspend or terminate access for conduct that violates these Terms.
AI-Generated Content Disclaimer
The App uses artificial intelligence to generate study materials, explanations, summaries, flashcards, quizzes, exams, and tutoring responses. AI-generated content may be inaccurate, incomplete, outdated, or misleading.
- Falak does not guarantee the accuracy, reliability, or suitability of any AI-generated content for any purpose.
- AI output is not professional, academic, medical, legal, or financial advice.
- You must independently verify all study material — especially before relying on it for exams, assignments, or graded work. Do not treat AI output as a substitute for your textbooks, instructors, or official course materials.
- You are responsible for ensuring your use complies with your school's or institution's academic-integrity policies.
Intellectual Property
The App, including its software, design, branding, "Falak" / «فلك» names and marks, "Sky" tutor, models, templates, and all related content (excluding your uploaded User Content), is owned by Falak Group or its licensors and is protected by intellectual-property laws. Subject to your compliance with these Terms, Falak grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on a device you own or control, for your personal, non-commercial study use. No other rights are granted. All rights not expressly granted are reserved.
User Content and Uploads
"User Content" means any files, PDFs, notes, text, or other materials you upload to or create within the App (including the Knowledge Bank).
- You retain ownership of your User Content.
- License to us. You grant Falak a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, and display your User Content solely to operate and provide the App to you — including processing it through AI systems to generate study materials and responses for you. This license exists only to deliver the service and ends when you delete the content or your account, subject to reasonable backup retention and legal requirements.
- Your responsibility. You represent that you own or have the necessary rights to your User Content and that its upload and use does not violate any law or third-party right.
- We do not claim ownership of your User Content and will not use it to publicly promote the App without your permission.
Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the App or other users. Upon termination, your license to use the App ends. Subscription payments already made are non-refundable except as described in the "Subscription Terms" section. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and governing law) will continue to apply.
Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. FALAK DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUT WILL BE ACCURATE OR RELIABLE. YOUR USE OF THE APP IS AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FALAK GROUP AND ITS OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GRADES, OR ACADEMIC OUTCOMES, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP OR RELIANCE ON ANY AI-GENERATED CONTENT. IN NO EVENT WILL FALAK'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FALAK IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) US$50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Governing Law and Disputes
These Terms are governed by the laws of [Governing law: _____], without regard to conflict-of-laws principles. Subject to any mandatory rights you have as a consumer, the courts of [Dispute venue: _____] will have exclusive jurisdiction over any dispute, except that Apple-related matters are also subject to the Standard EULA.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide notice within the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the App.
Apple-Specific Terms
You acknowledge that these Terms are between you and Falak Group only, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
